Privacy Policy

How we collect, use, store, and share your information when you use Avana.

Avana Live, LLC ("Avana," "we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, and share your information when you use the Avana mobile application. By using Avana, you agree to the practices described in this Policy.

As described in our Terms of Service, all video calls are temporarily recorded for safety purposes. Recordings are automatically deleted at the end of a call session if no report is filed. If a report is filed, the recording is retained solely for safety review and deleted following resolution. We do not use call recordings for any other purpose.

2. How We Use Your Information

We do not sell your personal data to third parties. We do not use your personal data for targeted advertising. However, we may use your email address and phone number to send you marketing and promotional communications about Avana, in accordance with your preferences and applicable law.

We may send you SMS messages for account verification, account notifications (such as match alerts, event reminders, and account activity), and marketing/promotional purposes. Message frequency may vary. Message and data rates may apply. Users may opt out of SMS communications at any time by replying STOP.

3. How We Share Your Information

3.1 With Other Users

Your profile information (name, photos, bio) is visible to other Avana users as part of normal use of the Service. Your full contact information, device data, and payment data are never shared with other users.

3.2 Service Providers

We share information with trusted third-party service providers that help us operate the App, including cloud infrastructure, payment processors, analytics providers, and customer support tools. These providers are contractually prohibited from using your data for any purpose other than providing services to Avana.

3.3 Legal Disclosure

We may disclose your information, including call recordings, where required by law, legal process, or government request. We will notify you of such requests where legally permitted to do so.

3.4 Business Transfers

If Avana is acquired, merged, or undergoes a similar transaction, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.

4. Data Retention

We retain your account information for as long as your account is active or as needed to provide the Service. You may request deletion of your account and associated data at any time (see Section 7). Retained call recordings are deleted following resolution of the associated report. Anonymized, aggregated usage data may be retained indefinitely.

5. Data Security

We implement industry-standard technical and organizational measures to protect your data, including encryption in transit (TLS) and at rest, access controls, and regular security reviews. However, no method of transmission over the internet is 100% secure. We cannot guarantee absolute security of your data.

6. Children's Privacy (COPPA)

Avana is not intended for users under the age of 18. We do not knowingly collect personal information from minors. If we discover that a minor has created an account, we will immediately terminate the account and delete associated data. If you believe a minor is using Avana, please report it to safety@avanalive.com.

7. Your Rights & Choices

7.1 Access & Correction

You may access and update your profile information at any time through the App settings.

7.2 Account Deletion

You may request deletion of your account at any time by contacting privacy@avanalive.com or through in-app settings. Upon deletion, we will remove your personal data within 30 days, except where retention is required by law or ongoing safety review.

7.3 Marketing Communications

You may opt out of promotional emails at any time by clicking "unsubscribe" in any marketing email or by contacting privacy@avanalive.com.

8. State-Specific Privacy Rights

8.1 California Residents — CCPA/CPRA

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

To exercise your California privacy rights, contact us at privacy@avanalive.com or submit a request through the App. We will respond within 45 days. You may designate an authorized agent to make requests on your behalf.

8.2 Virginia Residents — VCDPA

Virginia residents have rights under the Virginia Consumer Data Protection Act (VCDPA), including the right to access, correct, delete, and obtain a copy of your personal data; the right to opt out of profiling for decisions with significant effects; and the right to opt out of targeted advertising (we do not engage in targeted advertising). To exercise these rights, contact privacy@avanalive.com. You may appeal a denial of your request by contacting us at the same address.

8.3 Colorado Residents — CPA

Colorado residents have rights under the Colorado Privacy Act (CPA) similar to those described above for Virginia residents, including rights to access, correction, deletion, portability, and opt-out of profiling and targeted advertising. Contact privacy@avanalive.com to exercise these rights.

8.4 Connecticut Residents — CTDPA

Connecticut residents have rights under the Connecticut Data Privacy Act (CTDPA) including rights to access, correct, delete, and obtain a portable copy of personal data, and the right to opt out of targeted advertising and profiling. Contact privacy@avanalive.com to exercise these rights.

8.5 Texas Residents — TDPSA

Texas residents have rights under the Texas Data Privacy and Security Act (TDPSA), including the right to access, correct, delete, and obtain a copy of personal data; the right to opt out of targeted advertising and profiling; and the right to appeal our decisions. Contact privacy@avanalive.com to exercise these rights.

8.6 Tennessee Residents

Tennessee residents are subject to the Tennessee Information Protection Act (TIPA). As an App headquartered in Tennessee, we comply with all applicable TIPA requirements. You may exercise applicable data rights by contacting privacy@avanalive.com.

8.7 Nevada Residents

Nevada residents may opt out of the sale of personal information under Nevada law. Avana does not sell personal information. For questions, contact privacy@avanalive.com.

9. Cookies & Tracking

The App may use cookies, pixels, and similar tracking technologies to improve functionality and analyze usage. You can control cookie preferences through your device settings or by contacting us. We do not use tracking technologies for behavioral advertising.

10. International Users

Avana is operated from the United States. If you access the App from outside the United States, your information will be transferred to and processed in the United States. By using the App, you consent to this transfer. If you are located in the European Economic Area (EEA), additional rights under the GDPR may apply; contact privacy@avanalive.com for more information.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the effective date and notify you via email or in-app notification. Your continued use of the App constitutes acceptance of the updated Policy.

12. Biometric Data

Avana does not use facial recognition, biometric identification, or biometric data processing technologies. While users are required to show their face during video interactions, Avana does not collect, store, or analyze facial geometry or biometric identifiers.
